Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Teach Bay platform (the “Service”), operated by Teach Bay (“we”, “us”, “our”). By creating an account or using the Service, you agree to be bound by these Terms.

1. The Service

Teach Bay is an AI-powered homework, quiz, and assessment platform for South African secondary schools. The Service helps teachers generate CAPS-aligned questions, grade student work, and review topic-level performance.

2. Accounts

The Service is sold to schools. School administrators may provision teacher and student accounts. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

3. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose;
  • Attempt to reverse-engineer, scrape, or interfere with the Service;
  • Upload content that infringes any third party's rights or applicable law;
  • Share login credentials with anyone outside your school.

4. Subscription & Payment

Schools subscribe under a written agreement at rates quoted by our team. Fees, billing cycles, and payment terms are set out in that agreement. All fees are exclusive of VAT unless stated otherwise.

5. Student Content & Data

The school remains the controller of all student data uploaded to the Service. We process this data on the school's behalf in line with our Privacy Policy and the Protection of Personal Information Act, 2013 (POPIA).

6. Intellectual Property

The Service, including all software, designs, and AI-generated content templates, is owned by Teach Bay. You retain rights to the content you upload, and you grant us a limited licence to process it solely to provide the Service.

7. AI-Generated Content

Quizzes, grading suggestions, and feedback are produced with the assistance of AI models. While we review for CAPS alignment, you are responsible for confirming accuracy before using any content with students.

8. Service Availability

We aim for high availability but do not guarantee uninterrupted access. We may schedule maintenance, update features, or pause the Service to investigate security issues.

9. Termination

Either party may terminate the subscription as set out in the school agreement. We may suspend access immediately for material breach of these Terms. On termination, school data is exported or deleted in line with our retention schedule.

10. Liability

To the extent permitted by law, our aggregate liability is limited to the fees paid under the school agreement in the 12 months preceding the claim. We are not liable for indirect or consequential losses.

11. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any dispute is subject to the jurisdiction of the South African courts.
